Taqleed

TAQLEED
in the Qur'an and Ahadith

The Qur'an instructs Muslims to seek guidance from people of learning in matters about which they lack knowledge:

(وَمَا أَرْسَلْنَا قَبْلَكَ إِلَّا رِجَالًا نُوحِي إِلَيْهِمْ ۖ فَاسْأَلُوا أَهْلَ الذِّكْرِ إِنْ كُنْتُمْ لَا تَعْلَمُونَ)
[Surat Al-Anbiya : 7]

"Question the people of remembrance if you do not know." (21:7)

It is an obligation in Islamic law to study everything which is necessary for the spiritual and material development and well-being of an Islamic community, but it is an obligation which is known as wajib kifa'i.
(Wajib kifai: If one fulfils it there is no obligation on others)

In the present instance, for example, an Islamic society has need of experts in the medical sciences, in physics and chemistry, engineering, education, and so forth, and as long as there is a lack of knowledge in these areas it is an obligation on the community as a whole to acquire it, which means that a group of Muslims should devote themselves to research so as to benefit the Islamic people as a whole.

Similarly, an Islamic society without experts in the shari'ah cannot properly consider itself Islamic, so it is an obligation for a group of persons from this society to devote themselves to the study of the religious sciences, so as to provide divine guidance for all Muslims. This is the meaning contained in the verse of the Qur'an which states:
(وَمَا كَانَ الْمُؤْمِنُونَ لِيَنْفِرُوا كَافَّةً ۚ فَلَوْلَا نَفَرَ مِنْ كُلِّ فِرْقَةٍ مِنْهُمْ طَائِفَةٌ لِيَتَفَقَّهُوا فِي الدِّينِ وَلِيُنْذِرُوا قَوْمَهُمْ إِذَا رَجَعُوا إِلَيْهِمْ لَعَلَّهُمْ يَحْذَرُونَ)
[Surat At-Tawba : 122]

"But why should not a party from every section of them (the believers) go forth to become learned in the religion, and to warn their people when they return to them, that they may beware?" (9:122)

It is clear that the Imams used to be pleased if any of their companions taught religion or gave legal rulings (fatwa) to others. There are a number of documented cases of Shi'ahs who lived far from Medina asking the Imam of the time to appoint someone in their locality to adjudicate between them in religious problems. Zakariyyah ibn Adam al-Qummi and Yunus bin `Abdu r-Rahman, for example, were named by Imam `Ali ar-Rida' to solve disputes in their own districts.

In a famous hadith, `Umar ibn Hanzalah asked Imam Ja`far as-Sadiq, peace be upon him, about the legality of two Shi'ahs seeking a verdict from an illegitimate ruler in a dispute over a debt or a legacy. The Imam's answer was that it was absolutely forbidden to do so.

Then Ibn Hanzalah asked what the two should do, and the Imam replied: "They must seek out one of you who narrates our traditions, who is versed in what is permissible and what is forbidden, who is well-acquainted with our laws and ordinances, and accept him as judge and arbiter, for I appoint him as judge over you. If the ruling which he based on our laws is rejected, this rejection will be tantamount to ignoring the order of Allah and rejecting us is the same as rejecting Allah, and this is the same as polytheism."

In another tradition from Imam Ja'far as-Sadiq, this time narrated by Imam Hasan al-`Askari, peace be upon them, he says, "...but if there is anyone among the fuqaha' who is in control over his own self, protects his religion, suppresses his evil desires and is obedient to the commands of his Master, then the people should follow him."

A third hadith is from the Present Imam, Muhammad al-Mahdi, peace be upon him, who said in a reply to Ishaq ibn Ya'qub: "As far as newly occurring circumstances are concerned, you should turn (for guidance) to the narrators of our ahadith, for they are my proof over you just as I am Allah's proof."

We can understand two things from these verses of the Qur'an and the ahadith of the Imams:

1) there must always be a group of fuqaha' in every Muslim society;

2) those who are not qualified as fuqaha' or mujtahids, must follow one, and that to go against his instruction in religious matters is tantamount to polytheism., must follow one, and that to go against his instruction in religious matters is tantamount to polytheism.

The Necessary Conditions for Qualification as a Mujtahid
---------------------------

It can easily be inferred from the second of the ahadith cited above that becoming an expert in fiqh and the other Islamic sciences is not in itself enough for qualification as a mujtahid whom everyone can follow. In addition to this, Islamic law lays down that a mujtahid should be a free man of legitimate birth who is past the age of puberty, sane, an Ithna-`ashari Shi'ah, and `adil, (which can be translated as 'just', but which includes other moral and legal qualities, such as piety and abstention from all that the shari`ah forbids and fulfillment of all its obligations).

As to the question of how an ordinary believer should discover who is the mujtahid he must follow, there are three recognized ways:
-------------------------
1) by his own personal knowledge if he is himself a religious scholar;

2) by the testimony of two `adil, knowledgeable persons to someone's being a mujtahid;

3) by a degree of popularity which leaves no doubt as to a person's being a mujtahid.

Most present day `ulama' maintain that it is most desirable to follow a mujtahid who is al-a`lam. In a general sense this means 'the most learned', but in this specific contexts it means the faqih who has the greatest expertise in deriving the rulings of the shari`ah from the sources. The a`lam may be recognized in any of the three ways a mujtahid can.7

However, it is sometimes difficult for the Shi'ah `ulama' to distinguish whom among all the fuqaha' is the most learned, and, as a result, more than one mujtahid may be followed in taqlid at one time (though not, of course, by the same person), as is the case at present, but any such multiplicity does not result in any practical disagreement on legal matters within the Shi'ah community.

AN INTRODUCTION

The fact of supreme sacrifice of human history at Karbala by Imam Husain was not for wealth, glory or power, but he stood and marched for noble and ideal universal cause of truth, justice, morality and freedom of will. For this reason the tragedy of Karbala continues to be inspirational, influencing lives of billions of men and women, irrespective of caste creed or religion they profess (Christian, Hindu, Sunni, or Shia etc). Numerous stalwarts, Contributed to the world literature through ages, have advocated Husain's deed to be considered as of common human heritage, besides accepting Imam as a leader entire humanity for preserving human dignity and moral values under most adverse circumstances created by evil forces pregnant cunningness, material pomp and obstinacy.
Imam Husain uprooted despotism and had, and would remain a voice forever echoing through corridors of time.
According to Gibbon, the martyrdom of Husain will awaken the sympathy of the coldest reader. Any one, who hears or reads events of tragedy of Karbala, the natural any inevitable product is tears coming out of felling of sorrow and grief, but it is accompanied with felling of victory of achieved objective and triumph of purpose which gives men and women stimulus and impetus to go forward, whatever circumstances be.

Aaj ka daur

आज के दौर में इंसानों के दिलों से अपने रिश्तेदारों और दोस्तों की मुहब्बत कम होती जा रही है, और ज़रुरत के रिश्ते बनाने का रिवाज सा चल निकला है |

इस समाज में ऐसे बहुत से लोग हैं जो दो इंसानों का प्यार उनके अच्छे रिश्ते देख जल जाते हैं, जो की इर्ष्या वश होता है और उन्हें फ़िक्र यह सताने लगती है की कैसे उनके रिश्ते खराब किये जाएं?

और पहला मौक़ा मिलते ही ऐसे लोग रिश्तों को ग़लतफ़हमी पैदा कर के बिगाड़ दिया करते हैं |

ऐसा यदि कोई मुसलमान करे तो बहुत ही ताज्जुब होता है क्यूंकि इस्लाम में ऐसे इंसान के लिए जन्नत हराम करार दी गए हैं |

हजरत मुहम्मद (स.अ.व) ने फ़रमाया जो शख्स किन्ही दो लोगों में झगडे करवाए या उनके रिश्ते ख़राब करे अल्लाह उसपे गज़बनाक होगा और दुनिया और आखिरत में लानत करेगा |

इसका यह मतलब भी नहीं की अगर कोई आपके दोस्तों या रिश्तेदारों के रिश्ते खराब करवा दे या आपस में ग़लतफ़हमी पैदा कर दे तो पूरा इलज़ाम उसी पे रख दिया जाए |

रिश्ते खराब करने के ज़िम्मेदार आप खुद भी उतने ही हैं क्यूंकि अल्लाह ने आपको अक्ल दी है और हिदायत की सुनी सुनायी बातों पे यकीन कर के अपने रिश्ते आपस में खराब न करो|

और यदि कोई बात हो ही जाए तो कोशिश करो की रिश्ते को फिर से जोड़ने की |

हज़रात अली (अ.स० ) ने फ़रमाया की ज़िन्दगी के हर मोड़ पे सुलह करना सीखो क्यूंकि झुकता वही है जिसमे जान होती है अकड़ना तो मुर्दों की पहचान है |

इस्लाम की हिदायत यहीं पे ख़त्म नहीं हो जाती की रिश्ते किसी के कान भरने पे न बिगाड़ो या अगर बिगड़ जाए तो सुलह की कोशिश करो बल्कि इस से एक क़दम आगे जा के हिदया देता है की,

ऐ इंसानों अगर किन्ही दो लोगों में कोई शिकायत पैदा हो जाए और रिश्ते ख़राब हो जाएं तो उनके बीच में सुलह करवा दो और ऐसा करने का सवाब पूरे साल मुस्तहब नमाजें पढने से भी ज्यादा है |

इस सवाब से भी इस बात का अंदाज़ा लगाया जा सकता है की किन्ही दो लोगों में रिश्ते खराब करवाने की सजा कितनी ज्यादा हो सकती है ?

लोगों के बीच सुलह सफ़ाई कराने का अल्लाह तआला ने हुक्म दिया है और अल्लाह के पैग़म्बरों की भी यह ज़िम्मेदारी दी थी कि समाज में मतभेदों को दूर करते हुए शांति बनाए रखें|

अल्लाह तआला सूरा-ए-बक़रा की आयत नं 27 में उन लोगों के बारे में जो सम्बंध तोड़ते हैं, फ़रमाता हैः

फ़ासिक़ (गुनहगार व भ्रष्ट) वह लोग हैं जो अल्लाह के वचन को पक्का हो जाने के बाद तोड़ते हैं और जिन रिश्तो कों अल्लाह ने मज़बूत बनाए रखने का हुक्म दिया है उन्हें तोड़ते हैं और ज़मीन पर उपद्रव करते हैं, निस्चित रूप से यह लोग घाटा उठाने वालों में से हैं।

रसूले इस्लाम स.अ. लोगों के बीच सुलह सफ़ाई कराने के बारे में फ़रमाते हैं,

क्या में तुम्हें ऐसी चीज़ के बारे में न बताऊं जो नमाज़, रोज़े और ज़कात से ज़्यादा श्रेष्ठ है,

और वह काम लोगों के बीच सुलह सफ़ाई कराना है,

चूंकि लोगों के बीच रिश्तों में दूरी पैदा होना घातक, जानलेवा और दीन से दूरी का कारण बनता है।

(कंज़ुलउम्माल 5480, मुंतख़ब मीज़ानुल हिक्मा 324)।

इमाम सादिक़ अलैहिस्सलाम फ़रमाते हैं कि,

जब लोगों के बीच मतभेद पैदा हो जाये और आपस में दूरियां पैदा हो जाएं, ऐसा सदक़ा है जिसे अल्लाह तआला पसंद करता है।

(अल-काफ़ी 2/209/1,मुंतख़ब मीज़ानुल हिक्मा 324)।

अमीरूल मोमिनीन हज़रत अली अलैहिस्सलाम, अपने बेटे इमाम हसन अ. को सम्बोधित करते हुए फ़रमाते हैं कि मैंने रसूले इस्लाम स.अ. से सुना है कि लोगों के बीच सुलह सफ़ाई कराना एक साल की मुस्तहब नमाज़ों और रोज़ों से बेहतर है।

(नहजुल बलाग़ा वसीयत 47)।

हज़रत इमाम मुहम्मद बाक़िर अलैहिस्सलाम भी फ़रमाते हैं कि

अल्लाह उस पर रहमत नाज़िल करे जो हमारे दो दोस्तो के बीच सुलह सफ़ाई कराए, ऐ मोमिनों आपस में दोस्त रहो और एक दूसरे से मुहब्बत करो।

oos se unke 3 maqsad waabasta hain:

1) Unki taiyar ki huwi kuchh Riwaayaat GHULU (atishyokti / exaggeration) par mushtamil (aadhaarit / based) hai,

2) Kuch Riwaayaat TAQSEER (hum ko ghataane) par mushtamil hai

Aur

3) Kuchh Riwaayaat unhone aisi taraashi hain jin mein hamare dushman ke naam le kar aibo'n (faults) ko bayaan kiye hain.

Jab log GHAALIYANA (humko hadd se badhaane wali / exaggerated)
Riwaayaat sunenge to wo hamare Shiyo'n ko kaafir kahenge aur log ye kahenge ke Shia Ahlebait (as) ko Rab maante hain.
Aur
Jab log TAQSEER (humko hamari haisiyat se ghataane) par mabni Riwaayaat sunenge to wo hamare liye Taqseer par mabni aqeeda rakhenge

Aur

JAB LOG YE SUNENGE KE AHLEBAIT (AS) NE NAAM LEKAR APNE DUSHMAN KE AIBO'N KO BAYAAN KIYA HAI TO LOG BHI NAAM LEKAR HUMPAR SUB O SHATAM KARENGE (HAMARA NAAM LEKAR HAME BURA BHALA KAHENGE), JAB KE ALLAH TA'ALA NE (SURAH AN'AAM AYAT NO.108 MEIN) FARMAYA HAI "AUR TUM UNHEIN (BUUTO'N / IDOLS KO) GAALIYAA'N NA DO JINHE YE LOG ALLAH KE SIWA PUKAARTE HAIN, KAHI'N AISA NA HO KE YE JIHAALAT AUR ZYADATI KARTE HUWE ALLAH KO GAALIYAA'N DENE LAG JAAYEIN".
